Limitations
The warranties set forth are subject to the following limitations:

  1. The sellers responsibility and the buyer’s exclusive remedy under this warranty are limited to the repair or replacement of the defective part(s) or product. The seller shall not be liable for any incidental or consequential damages (including but not limited to loss or damage due to fire, water, theft or vandalism) to persons or property resulting from the breach of this or any other express or implied warranty applicable to the product. Some states, provinces and countries do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
  2. Except as may be otherwise provided by applicable law, the seller hereby disclaims any and all other covenants and warranties, whether written, oral, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Where provided by applicable law, such implied warranties shall be limited in duration to a period of the Term of Warranty (see above) from the date of purchase. Some states, provinces, and countries do not allow disclaimers or limitations of implied warranties, so the above disclaimer and limitation may not apply to you.
  3. These warranties shall be void if repairs are made without prior authorization of the seller.
  4. The seller is not responsible for damage to the product incurred during shipment. The product was packed in accordance with Interstate Commerce Commission specifications, and with reasonable handling, should be in good condition on arrival. Any claims for shipping damage should be made directly to the carrier.
  5. These warranties do not cover defects caused by modification, alteration, repair or service of the product by anyone other than the manufacturer or its authorized representative, or by physical abuse to or misuse of the product.
  6. No Hippo Game Depot employee, agent, representative, or dealer has the authority to make or imply any representation, promise or agreement that in any way varies the terms of this Limited Warranty.
  7. This Limited Warranty shall apply to new, products and shall not apply to previously owned products.
  8. Any warranty, as it applies to waterproof claims, shall not cover any products previously damaged by fire.

All of the provisions of this Limited Warranty are separate and severable, which means that if any provision is held invalid and unenforceable, such determination shall not affect the validity or enforceability of the other provisions hereof.

 Order Cancellation:

Each order is prone to differentiating cancellation fees. After cancellation from the customer, if the order has not started the shipping process we can refund the order with no problem. The refund will be processed in full minus the processing fee of 10%. If the safe is in the process of being shipped/delivered then the return of the safe will cost the amount of the shipping, restocking fee, and the processing fee. This will be taken from the amount that was previously paid by the customer from the order.

I ordered the wrong size/color or I changed my mind.

All you will need to do is send the items back to us at the address listed at the bottom of the page. Please call our customer service line, or send an email to the address listed below, to let us know that you would like a refund. All returned items must be in "as new" condition. “As new” means that the product is in the same condition in which you received it. Please return the item in the original packaging including any manuals, cabling and accessories in saleable condition. Items to be returned must be unused and unmodified in any way.

Please note that the customer is responsible for return shipping, and we do not refund the original shipping fees under these circumstances. All returns/exchanges must be submitted within 30 days of the date we ship out your order. Returns are processed within 2-5 business days from when they arrive at our warehouse. Depending on your bank, refunds can take up to two weeks.

I think my product is defective.

We warrant every product we make to be free of manufacturer defects in materials and workmanship. We will work with each customer to ensure that they are satisfied with their product. GLD does not warranty and is not responsible for damages caused by shipping, misuse, abuse, accidents, the natural breakdown of materials over time, or problems that may be reasonably expected with normal wear. Items have differing warranty lengths that can be found on specific product pages. If you have any questions please contact our support team.

RETURN POLICY:

* Items returned for refund or exchange must be new and unused, and in the original packaging. Returns and exchanges must be made within thirty days of purchase.
* No returns accepted for Custom-Made Paddles. When Paddle Palace cuts and applies rubber, the blade and rubber are not eligible for a return or exchange.
* All CD’s, DVD’s, and videos are non-returnable and non-refundable unless found to be factory defective.
* We do not accept a return or exchange for shoes or clothing which show any evidence of wear.
* Send returns to: Paddle Palace, 12230 SW Main St., Portland, OR 97223, USA. On a note inside the package include your name, address, phone number and contact info, reason for the return, original invoice#, and action expected of Paddle Palace.

 

 

First Team

Warranty Information:

All First Team products are warranted against manufacturers defects at delivery. Additionally, First Team warranties most products for a given period of time as stated in the literature. Below is and explanation of First Team's warranty levels.

Limited Warranty:

Covers any damage caused by normal basketball activity and normal player contact with the goal. "Normal basketball activity" and "Normal player contact" shall be described as any action that is necessary for participation in the game of basketball. Deliberate hanging on the rim, multiple player hanging, and vandalism are not covered under the Limited Warranty.

Superior Warranty:

Covers any damage or failure caused by any type of basketball activity or related contact with the unit. This includes deliberate hanging on the rim as well as multiple player hanging. The Superior Warranty does not cover vandalism.

Unconditional Warranty:

Covers any damage or failure that occurs for any reason. Any product carrying an Unconditional Warranty is exempt from the above stated limitations.

Any normal wear and tear caused by weathering or UV exposure is not covered under any First Team warranty. All painted items carry a one year limited warranty on coating.

First Team basketball systems listed solely under "Residential Basketball Packages" are warranted for residential use only! "Residential" is defined as a "single family dwelling." For a complete listing of basketball packages warranted for non-residential use, refer to the "Institutional Basketball Packages" section of First Team's price list. Under no circumstances shall any basketball package other than those listed under "Institutional Basketball Packages" be warranted for non-residential use.

Due to the abusive nature of amusement facilities, unless specifically agreed to in writing, First Team products carry no warranty except for obvious manufacturing defects when used in an entertainment facility where players pay a fee to use the equipment.

Warranty: All First Team products are warranted against manufacturing defects. Refer
to catalog for specific warranties on individual items.
Return Policy: Returns must follow prior authorization given by First Team. If an item
must be returned, contact First Team to receive a return authorization number. This
RA# must be clearly marked on all shipping labels. All returns must be shipped prepaid.
Collect shipments will not be accepted. Upon receipt of returned goods First Team shall
inspect and issue credit for items determined to be covered by warranty. A 35%
restocking charge may be assessed on all returned goods. Unopened returns that do
not require inspection will not be assessed a restocking charge.

 

 

Gared

 

PRODUCT WARRANTY
GARED HOLDINGS LLC (the "Company") warrants its MODEL #AFRG42 ALUMINUM FRAME GLASS BACKBOARD (BOARD ONLY)
(the "Equipment") against defects in material or factory workmanship for the LIFE of its intended and purposeful use from the
date of substantial completion (the “Warranty Period”). The glass portion of the backboard is warranted against breaking or
shattering ONLY when used with a Direct Goal Attachment as provided by Gared Holdings LLC (the “Company”).
GARED HOLDINGS LLC (the "Company") warrants its MODEL #2137 PERIMETER LED LIGHT KIT (the "Equipment") against defects
in material or factory workmanship for a period of ONE (1) YEAR from the date of substantial completion (the “Warranty Period”).
If you discover a defect in the materials or factory workmanship of the Equipment during the Warranty Period, you must promptly
notify the company in writing. You must also include proof of purchase and purchase date, installation date or date of substantial
completion. The Company will, at the Company's discretion, repair or replace the defective Equipment at no cost to you, except
for shipping, insurance and installation costs, which shall be your responsibility.
Should the glass break or shatter, you must promptly notify the Company in writing and retain the Direct Goal Attachment plate
to be returned with proof of purchase in addition to purchase date, installation date, or date of substantial completion. No
warranty will be honored against breakage or shattering without the return of the Direct Goal Attachment plate.
This warranty does not cover any loss or damage caused by (a) improper installation of the Equipment, (b) use of the Equipment
for purposes other than which it was intended, (c) disasters such as fire, flood, wind, and lightning, (d) unauthorized alterations or
modifications to the Equipment, or (e) any other abuse or misuse of the Equipment.
The Company's liability under this warranty is limited to the repair or replacement of defective Equipment. Your sole and
exclusive remedy against the Company shall be for the repair or replacement, at the Company's discretion, of any defective
Equipment as provided herein. *IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL
DAMAGES RELATING TO, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE EQUIPMENT,
INCLUDING AND WITHOUT LIMITATION, ANY LABOR AND/OR OTHER INSTALLATION EXPENSES INCURRED IN CONNECTION
WITH THE REPLACEMENT OF THE DEFECTIVE EQUIPMENT WARRANTED HEREUNDER, OR ANY OTHER INDIRECT DAMAGES WITH
RESPECT TO LOSS OF REVENUE OR PROFITS.
* Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or
exclusion may not apply to you.
*ALL IMPLIED WARRANTIES WITH RESPECT TO THE EQUIPMENT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS OF A PARTICULAR PURPOSE, ARE HEREBY LIMITED IN DURATION TO THE
WARRANTY PERIOD. *Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may
not apply to you.
No agent or representative of the Company or any other person has the authority to change or modify this warranty, either orally
or in writing, in any respect.
This warranty gives you specific legal rights. Additional legal rights may vary state to state

PRICES: Institutional prices are shown FOB factory. Prices are subject to change without notice and will be invoiced at prices in effect on the day of
shipment. Orders received for quantities other than standard pack or multiples thereof will automatically be changed to the next highest standard quantity
without notice. A $5 fee is charged for breaking products sold in pairs and a $10 fee is charged for orders less than $100.
FREIGHT: All freight is FOB factory and products are shipped by UPS, Parcel Post or common carrier. The customer may specify a carrier, but GARED
reserves the right to specify the carrier on all freight allowance shipments. If UPS shipment is requested, you may provide your UPS account number in
writing, or be charged handling fee based on the size of the shipment. Freight quotes will be faxed only and are not guaranteed. Requests for specific
common carrier, including quoted carriers, must be in writing on your PO. All common carrier shipments will be prepaid and added to your invoice or third
party bill. Cost of shipping by customer specified carriers who are not GARED preferred carriers is at the customer’s discount and risk. If no other
arrangements can be made, truck freight may be prepaid and added to the customer’s invoice with freight charges to be standard published rates less 60%.
GARED is not responsible for processing freight claim paperwork on third party shipments. GARED freight discounts are only valid if invoice is paid within
pre-determined terms.
DROP SHIPMENTS: Shipments made directly to the end-user are subject to minimum order fee noted above. Dealers must instruct the end-user to count
and inspect shipments when they are received and to note shortages and damages to the product or cartons on the freight bill before signing.
GOODS DAMAGED IN TRANSIT: The customer or end-user should note the nature and extent of goods damaged or suspected to be damaged in transit on
the freight bill before accepting and signing the bill. Title and risk of loss or damage of merchandise pass to the customer FOB factory, and it is the
customer’s responsibility to file damage or shortage claims, but GARED will provide assistance where feasible. Customer must notify any drop ship recipient
of required freight claim procedures. Photos must accompany any claim of damage if a freight claim must be processed.
REFUSED SHIPMENTS: If an order is refused, the customer will be charged for all freight, any merchandise damages and a restocking charge of 20% of the
invoice (with a minimum restocking charge of $50), unless GARED committed a shipping error.
LIMITED WARRANTIES: All GARED products are warranted against manufacturing defects as delivered. Many products are also covered for various lengths
of time with limited or unconditional warranties stated in the description of the product. Limited warranties cover damage or failure from normal and
intended use of the product, but not abusive activities. Unconditional warranties cover damage or failure from any use of the product or activity.
Deterioration of products due to weather or other causes that do not affect functional use are not covered by warranties. Warranties are valid only when
product is used for the intended purpose and installed according to GARED instructions. Any alteration or modification of the product by the end-user voids
any warranty. GARED shall not be liable for any incidental or consequential damages whatsoever. All merchandise is sold under these conditions, which no
representative of the company can waive or change. Any product without an indicated warranty possesses a 1 year limited warranty.
GARED will replace defective items upon their authorized return and will ship replacement product by ground freight only.
RETURNED GOODS: All merchandise returns require the prior authorization of GARED. A return authorization is obtained by providing us with the item
number, reason for return, invoice number and date of purchase. The return authorization number must appear on all return shipping labels. Returns
received without authorization numbers will be refused. Returns should be packed carefully to prevent damage in transit and must be shipped prepaid by
the customer; collect shipments will not be accepted. Credit for defective returns will be issued only when our inspection department determines that the
merchandise is covered by our warranty. Credit for all other returns is subject to a 20%, with a minimum of $50, restocking charge and the customer is
responsible for damaged merchandise and all freight costs. Delivered product must be returned within 90 days of purchase date to receive full refund.
Product that has been redesigned will not be accepted. Credits will not be issued for returned product if invoices on account are past due.

CUSTOMIZED PRODUCT RETURNS: Any order with customization including product configuration, product design, non-standard color, and non-standard
packaging may not be eligible for return. Additionally, if return is approved by GARED staff, a 50% disposal fee will be assessed.
HELD ORDERS: Orders that are held from shipment at customer’s request for longer than 3 business days after order is ready, OR orders not picked up at
our warehouse within 3 business days after order is ready, are subject to 20% storage fee per week of storage at our facility.
CHARGE BACK FEES: GARED refuses financial responsibility for charge back fees.
REDESIGN OF PRODUCTS: All product specifications are subject to change without notice.
WARNING: All sporting activities present the risk of injury to participants. Improperly maintained equipment or inadequately supervised programs
contribute to injuries. Equipment must be inspected and maintained to minimize risk to participants and spectators. Any alteration or modification of
product negates GARED’s warranty and product liability responsibilities.
The above conditions and terms supersede any that may appear on buyer’s purchase order.

 

 

 

Killerspin

Table shipments

Table orders arrive at destinations in approximately 10-15 business days. This applies to all standard LTL and White Glove Deliveries.

Expedited shipping available for additional fees per request and quote separately.

Table shipping include to the door (front door, back door, and garage) delivery to most cities in the 48 contiguous United States. Freight companies' rates are higher than average to certain areas of the United States and additional charges may apply. If so, you will be notified before your table is shipped.

All tables are shipped by FedEx Freight, Monday-Friday 8AM to 7AM. Some residential areas may be inaccessible by delivery truck, FedEx may be unable to access certain residential areas. If you feel that your required destination inaccessible to a truck: please contact Killerspin Customer Service prior to placing your order.

Killerspin will notify you once your table has been shipped, via email, and provide you with the tracking number. FedEx will also contact you via email and text messages to receive notifications for tracking and delivery details and if selected, to schedule a delivery time. If no delivery appointment is chosen, there is no signature required upon delivery.  

Should you need to make changes for any reason once the table has been shipped, additional charges may apply. If you need to make changes to your delivery, please contact FedEx at the customer service number provided in your text or email communication from FedEx.

If you select to the door delivery with an appointment, FedEx requires you to be present when the table is delivered for a signature. FedEx will provide liftgate service (a smaller truck specially equipped with a hydraulic lift) to easily get your table to the ground.

Additional services can be provided by FedEx, these include Inside Delivery, unboxing and box removal (additional charges apply). Please contact Killerspin before your shipment delivers if this service is needed.

If you require assembly, we have a separate White Glove Service, starting from $350.

Please notify Killerspin should you require any of the above services, there will be NO help in assembling the table unless requested.

Should you fail to comply with the arranged delivery time, you will be responsible for any additional charges for redelivery and/or storage fees established by the freight company.

Once the table is removed from the truck, and while the driver is still present, please make sure to inspect the table for any damage. Table damage must be noted on the Proof of Delivery at the time of delivery to ensure proper credit. If for any reason you suspect damage that is not visible, please note "Subject to Inspection" on the delivery receipt. Should the driver not allow you to make this notation please refuse the shipment and contact Killerspin. For any concealed table damage found after the delivery you must notify Killerspin within five (5) days of delivery to ensure proper credit. If you find your table has concealed damage do not assemble the table. If a table has freight damage and a pick-up by the freight company is required, you are responsible for re-packing the table in its original packaging. Should you fail to comply with the arranged pickup time and re-packaging, you will be responsible for any additional charges for new pick up and/or other such fees established by the Freight Company and Killerspin. 

Shipments outside the United States

Table shipments to Canada might be charged extra shipping based on the shipping zone and all duties and taxes must be paid by the consignee.

Warranty

All products have a 30 day warranty against factory defective merchandise with the exception of tables, which have a 1 year limited warranty. This warranty does not cover misuse, or customer inflicted damage to a product. Any products that are requested to be assembled, such as Blades and Rubbers, are taken as is, unless damage occurs due to shipping. All used products are taken as is. Beyond the warranty, parts are available for sale from Killerspin for certain products, such as tables.

Return policy

If there is extensive damage to the product, please contact Killerspin Concierge Service at 866-577-6291 or concierge@killerspin.com at your earliest convenience, and reference your order/shipment number. All products with shipping or factory damage will be replaced or refunded by Killerspin. More information may be required depending on date and products ordered.

Prior to return of any and all merchandise, a proof of purchase and authorization must be made by Killerspin via e-mail phone. Customer must initiate the return process within 30 days upon delivery. Any returned product must be returned in its original packaging and in saleable condition, to an address provided to you by a Concierge Service Representative, or the customer will be charged with a 25% re-stocking fee.

Products must be new, unused, and contain all original accessories. Rubber, nets, and balls cannot be returned if opened.

Returned goods must be shipped with freight prepaid via US Postal Service, UPS or FedEx, or an LTL freight company of your choice (for larger items, such as tables). Refunds will not be given for the shipping costs. This applies to all products, including tables. If the returned merchandise is found to be factory defective, a shipping label would be provided to you by a Concierge Service Representative.

Products returned, and in the opinion of Killerspin that appear to be damaged by the customer, will NOT be accepted for return, exchange or refund. A customer requesting the return of the damaged product which was sent to and received by Killerspin will require all shipping charges to be charged to the customer for the return of such product or products, unless arrangements of such products are made in advance and authorized by Killerspin.

Order Acceptance and Cancellation

Nuevo’s Account Registration Forms must be signed by an authorized signing authority for an account to be opened and prior to Nuevo’s confirmation of any orders.

You agree that your order is an offer to buy, under these Terms of Sale, all products listed in your order. All orders must be accepted by us or we will not be obligated to sell the products to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered.

All prices, discounts, and promotions posted on this website are subject to change without notice. The price charged for a product will be the price advertised on this website and confirmed on your order confirmation (price tiers can change price after official registration) at the time the order is placed, subject to the terms of any promotions or discounts that may be applicable. Price increases will only apply to orders placed after the time of the increase.

Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your total price. Taxes will be itemized in your shopping cart and in your order confirmation email. Shipping and Handling will be determined based upon level of service at time of shipment.   • Nuevo does not accept COD, prepaid checks, or debit cards.
  • Credit terms and limits are strictly applied. Nuevo reserves the right to withdraw credit terms at any time.
  • A 2% late fee per month is applied to all overdue accounts. A service charge of $25 will be applied on all NSF or returned checks.
  • Shipments will be held or cancelled on overdue accounts and merchandise will not be reserved.

Orders

  • All orders are subject to acceptance by Nuevo.
  • All cancellations or changes to orders must be received by email up to 72 hours prior to order ship date, or as approved by management.
  • Nuevo customers are not permitted to refuse shipments. Any issues due to handling must be clearly noted on the Bill of Lading when received.
  • All products should be inspected by the receiver for handling issues prior to delivering to the end consumer.
  • All marble and glass tops must be inspected upon receipt.
  • Clearance items are final sale.

Shipments

Shipments; Delivery; Title and Risk of Loss

We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges unless otherwise specified in the order confirmation.

Title and risk of loss pass to you upon our transfer of the products to the carrier at our warehouse dock in Cheektowaga, NY. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

Drop Shipments
  • A handling charge of $15 is applied to all drop ship orders that are shipped small package.
  • A handling charge of $25 is applied to all drop ship orders that are shipped LTL.
  • All drop ship fees apply to 3rd party shipments, as well as collect pick-ups.
  • ForALL Drop Ship Orders; responsibility for all product and freight claims transfers to Nuevo’s customers and Nuevo will not be held liable or responsible if the ultimate drop ship recipient does not adhere to Nuevo’s returns and Claims policy.
  • Refused drop ship orders are the responsibility of the buyer and will be returned to buyer's store or warehouse.
Small Package Prepaid Shipments
  • Certain products are approved to ship via small package couriers.
  • Nuevo will not be responsible for any damages that may be incurred if an account authorizes small package shipping for products that are not small package certified.
  • No delivery appointments are made and no signatures are required for small package deliveries
Pallet Prepaid Shipments
  • Unless otherwise specified by the customer, LTL orders will ship 'Prepaid' with Nuevo's preferred carrier.
  • All truck shipments are sent with a packing slip and a bill of lading showing the number of cartons and pallets shipped.
  • A residential delivery fee of $65 will be applied to all residential deliveries (any location without a loading dock).
  • Any additional fees billed to Nuevo by the carrier will be invoiced on the customer's account.
Freight Collect
  • All orders shipped freight collect require a freight account number unless otherwise specified by the customer.
  • Nuevo is not responsible for any merchandise damaged in transit.
Claims
  • Nuevo requires all of the following information emailed to claim@nuevo-ca.com in order to process any claim
    • Photos of Damaged or Defective Merchandise
    • Photos of the Boxes
    • Nuevo Invoice Number
    • A signed copy of the Bill of Lading if the order was sent LTL. Any damage to the packaging/product due to handling must be noted on the Bill of Lading.
    • A Brief Description of the Problem
  • Product and packaging are not to be discarded until directed by Nuevo
  • All required documentation must be received by Nuevo within twenty (20) days of receiving a shipment. For freight claims, all required documentation must be received by Nuevo within five (5) days
  • Nuevo is not responsible for any damages that may have occurred as a result from freight or handling when an order was picked up by a customer, or when an order was shipped 'Collect' or 'Third Party Collect'.
  • After five (5) days, Nuevo will not accept any freight claims, and Nuevo will only process claims under the manufacturer's warranty.
  • It is Nuevo's policy to send replacement parts where it is feasible.
  • Any replacement for marble parts and any glass pieces that cannot ship small package must be shipped as part of another order.
  • If parts cannot be replaced easily, Nuevo will send replacement unit(s).
Returns
  • No returns will be accepted without obtaining a Nuevo Return Merchandise Authorization Number (RMA#) issued by Nuevo. Call 1-800-894-2226 or email our After Sales Department at claim@nuevo-ca.com to obtain an RMA# before shipping your product.
  • All items must be returned without damage. All items must be returned in their original packaging.
  • All returns must have the Nuevo Return Merchandise Authorization Number (RMA#) clearly marked on all packages.
  • All returns must be shipped to: Nuevo, 60 Industrial Parkway Suite 077, Cheektowaga, NY 14227
  • A 20% restocking fee will apply to all returned merchandise in unopened cartons and in saleable condition.
  • Return freight for stock items must be prepaid by the customer and returned without damage in their original packaging. You bear the risk of loss during shipment. We, therefore, strongly recommend that you fully insure your return shipment against loss or damage and that you use a carrier that can provide you with proof of delivery for your protection.
  • Subject to your compliance with Nuevo’s return policy and procedures, Nuevo will accept returns due to buyer’s remorse up to a maximum of thirty (30) days from when the order was shipped from Nuevo’s warehouse.
  • Nuevo will not accept returns for any reason on items that have been discontinued or purchased on sale on or any products designated on this website as non-returnable.

Product Warranties

Furniture Warranty
  • All Nuevo products are warranted to be free of manufacturer defects in workmanship and materials for one (1) year from the date the product is invoiced by Nuevo.
  • The warranty covers manufacturing defects or deficiencies only. Nuevo's manufacturer’s warranty does not cover any damages related to or created by the mishandling or misuse of a product.
  • Any product to be used for purposes other than residential application must be specified by the buyer. Please see our Commercially Viable Policy
  • Any mishandling, tampering, misuse or abuse of a product or if the product is not used for the purpose for which it was manufactured will void the applicable warranty set out herein.
  • Nuevo will not reimburse customers for any charges incurred with respect to a product under warranty, unless the customer received approval from Nuevo, prior to incurring the charge.
Lighting Warranty
  • All Nuevo lighting parts are warranted for ninety (90) days from the date of receipt.
  • This warranty does not include any item that was the subject of a previous claim or damaged during installation/assembly.
  • This warranty does not include electrical components. Electrical components are covered by Nuevo's one-year manufacturer's warranty.
  • LED lighting is the exception to the Nuevo Warranty. LED lighting has a three (3) year warranty.
  • If an entire unit must be replaced, the original unit’s components are not covered by this warranty.
  • Customers must submit claims for complete units as a freight claim or under Nuevo's manufacturer’s warranty
  • Nuevo’s lighting is certified for indoor, dry environments only and is not commercially certified. Any use other than a residential application must be specified by the buyer.
Upholstery Warranty (HGSC only)
  • 10 years on frame
  • 2 years on cushions
  • 2 years on fabrics

Nuevo shall not be liable for a breach of the warranties set forth in above unless: (i) you give written notice of the defective products, reasonably described, to us within 20 days of the time when you discover or ought to have discovered the defect; (ii) if applicable, we are given a reasonable opportunity after receiving the notice of breach of the warranty to examine such products, and you (if we so request) return such products to our place of business at your cost for the examination to take place there; and (iii) we reasonably verify your claim that the products are defective.

We shall not be liable for a breach of the warranty set forth above if: (i) you make any further use of such products after you give such notice; (ii) the defect arises because you failed to follow our oral or written instructions as to the storage, installation, commissioning, use or maintenance of the products; or (iii) you alter or repair such products without our prior written consent.

Subject to your compliance with the foregoing two paragraphs, with respect to any such products during the applicable warranty period, we shall, in our sole discretion, either: (i) repair or replace such products (or the defective part) or (ii) credit or refund the amounts paid by you for such products provided that, if we so request, you shall, at your expense, return such products to us.

THE REMEDIES SET FORTH ABOVE SHALL BE THE YOUR SOLE AND EXCLUSIVE REMEDY AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED PRODUCT WARRANTIES SET FORTH ABOVE.

Nuevo’s MAP Policy is designed to provide a clear and effective method for all Nuevo Customers and Partners to succeed. The MAP Policy is also designed to protect Nuevo’s intellectual property, Nuevo’s brand, Nuevo’s Customers’ competitiveness and adheres to industry norms.

This policy only applies to ‘advertised’ price and not to the setting of prices. As such, it does not apply to point of sale pricing and in-store marked pricing.

MAP Policy:

    1. Nuevo’s Customers cannot advertise a sale price below the listed MAP price.
    2. MAP Pricing cannot be used in conjunction with or combined with any other incentive or promotion, except freight and handling promotions and the limited exclusions, as detailed in Point #4 — Exclusions.
    3. Nuevo’s Customers must disclose all websites operated, affiliated or associated with their account. Any 3rd party association must also adhere to Nuevo’s MAP Policy. Any Customer dealing with 3rd Parties who do not adhere to MAP will be treated as directly violating MAP. Nuevo reserves the right to close accounts who are selling through non-compliant 3rd parties
    4. Exclusions. The only exclusions from the Nuevo MAP Policy are:

      • Nuevo MAP exclusion list: A limited list of regularly priced items are excluded from MAP Policy pricing due to confusion of like and similar product within the Modern Contemporary Furniture market.     5. Companies found in violation of MAP Policy will:.

First Offense: The offending Nuevo Customer will receive written notice of violation and will be provided 48 hours to correct all violations.

Second Offense: The offending Nuevo Customer will have their account(s) put on hold and will be provided 48 hours to correct all violations.

Third/Additional Offense: The offending Nuevo Customer will have their account put on hold and all orders canceled. The offending Customer Account may be closed after an internal review. The offending Nuevo Customer must adhere to all required terms and conditions when an account is closed, including but not limited to; the return of all Intellectual Property, cessation of use of any Intellectual Property and the termination of access to Nuevo’s on-line services.

Commercially Viable

Many products sold by Nuevo are Commercially Viable.

Commercially Viable means the products are designed and constructed of materials suitable for commercial application.

Terms and Conditions:

    • Products are as specified in the Product Specification Sheet.
    • Nuevo tests a limited number of products to BIFMA standards.
    • Nuevo does NOT test all products specified as Commercially Viable to BIFMA standards.
    • It is the sole obligation/responsibility of the purchaser/specifier to ensure that a product specified as Commercially Viable is suitable for its intended use and is properly installed. Nuevo is not liable for any damages that results from the improper installation or use of products specified as Commercially Viable.
    • Additional/product specific testing, to ensure that a product is tested for its intended use is available upon request – terms and conditions to be determined on a case by case basis.
    • Except as specifically set out herein, no other terms and conditions apply.
    • Nuevo makes no representations or warranties in respect of any product, except as specified herein..
